Above Public Affairs LLC (“Above,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect through the websites we operate, how we use it, and the choices you have.
Which Sites This Covers
This policy covers the two websites Above operates directly:
- abovepublicaffairs.com — our firm website.
- txdcm.abovepublicaffairs.com — the Texas Data Center Tracker.
The two sites collect different things, so this policy says which is which throughout. We also build and host websites for clients and campaigns; those are separate sites with their own privacy notices, and this policy does not describe them.

What We Collect
On both sites
Our hosting provider (WP Engine) and our content-delivery and security provider (Cloudflare) keep standard server logs: IP address, browser and device type, the pages requested, and timestamps. These are ordinary operational records used to run the sites and protect them from abuse.
On abovepublicaffairs.com
If you RSVP to an event. The RSVP form collects your name, email address, organization, whether you plan to attend, the number of guests you are bringing, and anything you write in the note field. We store that with the event record and send you a confirmation email with a calendar invite attached.
If you email us. Our contact page lists an email address rather than a form, so anything you send us arrives as ordinary email and we keep whatever you chose to include.
Analytics. We use Google Analytics 4 to understand how visitors use this site — pages viewed, time on site, approximate location at the city or region level, device and browser type, and the site that referred you. It runs on every page for visitors who are not signed in to our WordPress admin.
Newsletter. Our newsletter runs on Substack, not on this website. Our subscribe page embeds Substack’s signup form directly in the page, which means that loading that page loads content from Substack, and Substack can see your IP address and may set its own cookies — whether or not you subscribe. If you do subscribe, your subscription is governed by Substack’s privacy policy, not this one.
On the Texas Data Center Tracker
An email address, and nothing else. To unlock the county map and the weekly activity feed, you enter an email address. That address is all we store — no name, no organization, no profile, nothing inferred about you. We send one welcome email, and we do not email you again unless you ask us to.
No analytics and no advertising. The tracker runs no analytics, no advertising or retargeting tags, and no third-party tracking of any kind.
Fonts. The tracker loads its typeface from Google Fonts. Your browser makes that request directly to Google, which discloses your IP address and basic browser information to Google in the process. We intend to serve the font from our own server, which will remove this.
Rate limiting. To keep the signup form from being abused, we count recent submissions per IP address. The address is converted into a one-way hash that we use as a temporary cache key; the key expires within an hour, and we do not store the IP address itself or keep any log of it.
Advertising
We do not use advertising or retargeting technology on either site. There is no Meta Pixel, no LinkedIn Insight Tag, and no Google Ads conversion tracking. We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
Cookies
- _ga and _ga_* — abovepublicaffairs.com only. Set by Google Analytics to tell one visit apart from another.
- __cf_bm — both sites. Set by Cloudflare to distinguish automated traffic from people. Expires after about 30 minutes.
- txdcm_gate — the tracker only. Records that you unlocked the map so you are not asked again. Expires after one year.
- txdcm_gate_new — the tracker only. Lets the page confirm you are on the list, exactly once. Expires after five minutes.
- Substack cookies — set by Substack on our subscribe page, through the signup form embedded there.
The tracker’s two cookies are the only cookies either site sets for its own purposes, and neither is used for advertising. You can control or block cookies in your browser settings; if you block the tracker’s, the map will simply ask for your email address again.
How We Use Information
- To respond to you when you write to us or RSVP to something
- To send the tracker’s single welcome email
- To understand and improve how visitors use abovepublicaffairs.com
- To keep the sites running, and to protect them from abuse
- To comply with legal obligations
Who We Share It With
- WP Engine — hosts both sites.
- Cloudflare — content delivery and security for both sites.
- Google — analytics on abovepublicaffairs.com; fonts on the tracker.
- SendGrid (a Twilio company) — delivers the tracker’s welcome email.
- Substack — runs our newsletter and the embedded signup form.
- Law enforcement or others, where we are required by law.
We do not sell your personal information to anyone.
Error reporting. Both sites report technical failures to an internal service we operate, so that we notice when something breaks. These reports are built to exclude personal information: when an email signup fails, the report carries an internal record number and the technical error, never the email address itself.
Email and Unsubscribing
Signing up on the tracker gets you one welcome email. Every email we send carries an unsubscribe link, and supports one-click unsubscribe in mail clients that offer it. Unsubscribing takes effect immediately and needs no account or password. If a link ever fails, email contact@abovepublicaffairs.com and we will remove you by hand.
How Long We Keep Things
- Tracker email addresses — until you unsubscribe or ask us to delete them.
- RSVPs — kept as a record of the event.
- Analytics data — kept according to Google Analytics’ retention settings.
- Server logs — kept according to WP Engine’s and Cloudflare’s standard retention.
Your Choices
Email contact@abovepublicaffairs.com and we will, on request:
- Tell you what information we hold about you
- Correct anything that is wrong
- Delete it
We offer this to anyone who asks, wherever you live, rather than only where a particular law requires it. You will never be treated differently for asking.
You can also block cookies in your browser, and you can opt out of Google Analytics everywhere using Google’s opt-out browser add-on. Because we do not sell or share personal information for advertising, a Global Privacy Control signal has nothing to opt you out of on our sites; if that ever changes, this policy will change first.
Children’s Privacy
Neither site is directed to children under 13, and we do not knowingly collect personal information from children.
Changes to This Policy
We may update this Privacy Policy from time to time. The “Last updated” date at the top reflects the most recent revision.
